Раздел 8 статьи I Конституции США [Constitution, U.S.], в котором перечисляются властные полномочия Конгресса [Congress, U.S.]: Конгресс имеет право "... издавать все законы, которые необходимы и уместны для осуществления вышеперечисленных полномочий и всех других полномочий, предоставленных настоящей Конституцией правительству Соединенных Штатов, или какому-либо его департаменту, или должностному лицу" ["To make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested in this constitution in the government of the United States, or in any department or officer thereof"]. И хотя полномочия Конгресса являются лишь делегированными [delegated powers], это положение, в трактовке Верховного суда США [Supreme Court, U.S.], фактически наделяет Конгресс неограниченными законодательными правами. Это положение было использовано Верховным судом для формулирования концепции "подразумеваемых прав" [implied powers].
